TERMS OF SERVICE

It is a requirement that all clients commissioning work from me read and accept all these terms and conditions. Please, read through each policy thoroughly, as violation of these terms may result in the cancellation of your commission and blacklisting you from future sales. You are agreeing to these ToS by buying any kind of art from me (commission, adoptable, lineart base... you name it). These terms are always subject to change, at any time, without notice.

GENERAL TERMS

  • I reserve the right to deny any commission for any reason.

  • Client is ONLY purchasing a digital picture (.PNG file), not a physical print nor the original file.

  • I take no deadlines for commissions, unless stated otherwise (e. g. artwork that is meant to be a birthday gift may be discussed).

  • Commission turnaround is usually up to one month, however it may take up to a few months to complete it, depending on the complexity of the drawing and personal schedule. In that case the client will be properly informed about delay(s) and is allowed to ask about progress anytime.​

  • I retain a certain level of creative freedom as my style is constantly evolving, however the client is guaranteed to receive an artwork in similar style and quality as my most recent artworks at the time of ordering.

CHARACTER REFERENCES

  • Client must provide a clear visual character reference. I do not work from text descriptions unless they complete (clarify) the visual reference. Working with photo references, traditional drawings, messy sketches etc. alone may be not accepted or charged extra.

  • Client is expected to provide detailed information about their character, requirements, and preferences for the commission at the beginning of the process (especially for custom design commissions), as it's my intention to achieve the best result possible.

    • Any additional information or changes demanded during the drawing process may be ignored or applied for additional charges. 

  • I reserve the right to interpret your character in my own style. This includes things like minor adjustments to colors and markings to fit my art style better. Details that are not present in the reference (e.g. paw or mouth color) will be picked by me, unless specified otherwise.

PAYMENT & REFUNDS

  • Payments are only accepted via PayPal invoices (which will be send in EUR) - the full payment is required upfront.

  • Payment plans are available for commissions (possibly adoptables) with the final price over 200 EUR. In this case details will be discussed with the client, with a general down payment of 100€ (EUR) minimum.

    • In this case the full payment may not be required upfront, depending on mutual agreement.

  • I retain the right to cancel a commission at any time for personal reasons with a full refund guaranteed for the client unless the reason of the cancelation was ToS violation or harassment. In that case only partial refund will be issued and said client will be blacklisted from future sales.

  • Commissions canceled by clients for any reason will still be finished with no refund. Please be responsible with money and don't spend what you might lack.

    • In special cases this point may be discussed, but not guaranteed.​

WORKING PROCESS

  • I'll start to work on the sketch once the full payment is received (excluding payment plans). After finishing it will be sent to the client for an approval. Client may ask for changes and adjustments to be made, or request one entirely new sketch.

    • Demanding more than one additional sketch may cost extra.

    • The original sketch will be saved for future use by me and will no longer be part of your commission.

  • I don't provide information about the progress automatically, but the client may request work in progress previews (WIPs) at any time.

  • No major changes will be made after the sketch is approved. I take no responsibility for getting the design wrong if an improper information or unclear reference was given to begin with. Any changes requested after the artwork is finished will be either ignored or charged an extra fee.​

  • Any mistakes made by me (e.g., overseeing a clearly visible marking) will be fixed free of charge.

COPYRIGHT & USAGE

  • I (the artist) retain all rights to the commissioned artwork. That includes the right to print, distribute or include your commission in any of my future works or collections, use it for further advertisement of my work or as an example of my commissions.​​

  • ​You (the client) may use the artwork for personal purposes only. That includes reposting it on your social media or present yourself and/or your character with it, but proper credit must be given every time. Altering the image in any way (or have someone to alter it for you) is forbidden unless my written permission was given upfront. 

  • Any artwork bought from me may NOT be used for commercial purposes (merch, prints, you name it) and redistribution of my artwork for uses other than personal is strictly prohibited. However commercial rights to the artwork may be purchased, pricing would be individual to each artwork based on its purpose. Only commissioner may purchase those rights.

    • I retain all rights to use the artwork in non-profit way even after commercial right have been sold.

  • The watermark must never be removed. If you are displaying a cropped or edited version wherein the watermark is no longer visible, it is required to visibly display credits elsewhere.

  • Client may request (upfront) to keep the commissioned artwork private until a specified date or indefinitely if its theme is too personal for you or if the artwork is meant to be a gift. In that case the artwork will not be uploaded to my social media (Deviantart/Twitter), but they still may be used as examples of my commissions and/or in personal portfolio.

    • If you wish the commissioned artwork to stay completely private (i. e. not used for my own purposes as those as listed above), an additional fee of 50% cost of the commission may be applied to cover loss of ad revenue due to my inability to share the piece.​

  • Absolutely none of my work (commissions or otherwise) may be used in any blockchain-related technology, to include NFTs, cryptocurrency, or future inventions in the space.

ADOPTABLES & DESIGNS

  • Once fully paid, you gained the ownership over the design and may use it however you want.​​

  • Unless otherwise stated, you are only purchasing the rights to the design, not the concept nor species as a whole. If it's your intention to turn purchased design into closed species (or something similar), the ownership rights of the entire concept must be purchased.

    • The pricing process of concept ownership would be similar to the pricing process of commercial rights in "Copyright & Usage"​ section.

  • The design itself may be altered in any way to any extent, but the artwork may not. Usage of the artwork featuring purchased design falls strictly under "Copyright & Usage"​ section.

  • The design may be traded or resold however the owner deems fit. However intentionally buying a design just to resell them afterwards at a higher price purely for profit will cause you getting blacklisted from future sales.

    • I do not keep track of design ownership beyond the initial purchase, hence there's no need to inform me about changes in ownership.

  • It's only required to credit me as the original designer and artist when reposting the original artwork and in character's Toyhou.se page (or sites with similar purpose).​​

These terms are constant work in progress and changes are expected to be made, though it is my intention to do is as little as possible. If you got any questions, please ask. (Last update November 13th 2023)
